Privacy policy

Translation for information only. This English text is a convenience translation. Only the German version (Datenschutzerklärung) is legally binding.

This page explains which personal data we process on planago.de, for what purpose, on what legal basis and what rights you have. Sections 6 to 9 are complete translations of the corresponding sections of the German privacy policy. The general parts of the German version (definitions of terms, the detailed description of your rights and of the legal bases) are summarised here in substance. Only the German privacy policy is legally binding.

1. Controller

The controller within the meaning of the General Data Protection Regulation (GDPR) and other data protection laws is:

You can use our website without telling us any personal data. We only process personal data where this is necessary for a specific service (e.g. answering an enquiry or a purchase) or where you have consented.

2. Server log files

Each time our website is accessed, our server stores general data in log files: browser type and version, operating system, the referring website (referrer), the pages accessed, date and time of access, IP address, internet service provider and similar data used to avert threats in the event of attacks. We do not draw any conclusions about you from this data. It is needed to deliver our website correctly, to ensure the long-term functioning and security of our IT systems and, in the event of a cyber attack, to provide law enforcement authorities with the necessary information. The log data is stored separately from any personal data you provide.

Legal basis: Art. 6(1)(f) GDPR. Our legitimate interest lies in particular in protecting our IT systems. The log files are deleted once these purposes have been achieved.

3. Contact by email or contact form

If you contact us by email or via a form, we store the data you transmit (e.g. name, email address, message) in order to process your enquiry and to contact you. The legal basis is your consent pursuant to Art. 6(1)(a) GDPR, which you give by sending your message. You can withdraw your consent at any time with effect for the future, e.g. by email to info@planago.de; the lawfulness of processing carried out before the withdrawal is not affected. For details, including on transfers to third countries, please refer to section 4 of the German privacy policy.

When entries are made via forms on our website, the IP address and the date and time of the entry may also be stored to prevent misuse (Art. 6(1)(f) GDPR). This data is not passed on to third parties unless there is a legal obligation to do so or it serves criminal prosecution.

4. Purchase and payment via Stripe

When you buy a licence or order Planago with hosting, we process the details you enter (name, company, email address) as well as your billing address and payment data for processing the contract, issuing the invoice and sending the licence. Payment is processed by Stripe. In doing so, personal data such as names, addresses, email addresses, phone numbers, bank and payment information and transaction data are processed; this is necessary to provide the payment services, prevent fraud, offer customer support and meet legal requirements.

The operator of the service and therefore the recipient of the personal data is Stripe, Inc., 354 Oyster Point Boulevard, San Francisco, CA 94080, USA. For data subjects in the EU and EEA, Stripe Payments Europe Limited, 1 Grand Canal Street Lower, Grand Canal Dock, Dublin, D02 H210, Ireland, acts as contact and representative within the meaning of Art. 27 GDPR. The representative under UK law is Stripe Payments UK Ltd., 9th Floor, 107 Cheapside, London, EC2V 6DN, United Kingdom.

Legal basis: performance of a contract pursuant to Art. 6(1)(b) GDPR and legitimate interests pursuant to Art. 6(1)(f) GDPR (improving our services, fraud prevention, using efficient payment applications and complying with legal requirements). Stripe is based in a third country (USA). Transfers to third countries may be based on standard contractual clauses or other appropriate safeguards pursuant to Art. 46(2) GDPR; you can request a copy of the safeguards from us. Data is stored for the duration of statutory or contractual retention periods. Providing the data is required for concluding the contract; without it, our services cannot be used. For the consents given when ordering (terms, privacy, early expiry of the right of withdrawal), we store the time of the order and your IP address as evidence.

5. Hosting with Hetzner

Our website, the live demo and the installations of Planago with hosting run on servers of Hetzner Online GmbH, Industriestr. 25, 91710 Gunzenhausen, Germany (representative under UK law: Hetzner Ltd., 7 Coronation Road, Dephna House, Launchese 105, London, NW10 7PQ, United Kingdom). Data processed in this context may include names, addresses, contact details, payment information and usage data of the services provided; it is needed to provide the services, offer support and ensure the security of the systems. Legal basis: Art. 6(1)(b) GDPR and Art. 6(1)(f) GDPR, our legitimate interest being the use of secure, reliable and efficient hosting. Further information: hetzner.com.

6. Audience measurement with GoatCounter

On this website we use the web analytics service GoatCounter to analyse visits. The provider is GoatCounter B.V., Prins Bernhardstraat 26, 4051 CH Ochten, Netherlands. We operate GoatCounter ourselves (self-hosted on our own server at Hetzner Online GmbH in Germany); no data is transmitted to the provider of GoatCounter or any other third party.

GoatCounter does not use cookies or any other information stored on the data subject's device and is designed so that individual visitors cannot be recognised across several page views or websites. Only aggregated, anonymous figures are recorded, including the page accessed, the referrer (the page from which the data subject came to our website), browser type, operating system, screen size and a rough location (country) derived from the IP address. The IP address itself is not stored. The data collected cannot be attributed to a specific person.

The purpose of the processing is the statistical evaluation of user behaviour in order to optimise our website. The legal basis is Art. 6(1)(f) GDPR; our legitimate interest lies in designing and improving our website in line with demand. As GoatCounter uses neither cookies nor comparable technologies to store information on the data subject's device, consent pursuant to § 25 TDDDG (German Telecommunications Digital Services Data Protection Act) is not required.

Local settings: In your browser's storage (localStorage) we only keep your choice of display (light/dark) and, if you have dismissed it, that the note about the English version should no longer appear. This information does not leave your device and serves solely the display you requested (§ 25(2) no. 2 TDDDG).

7. Live demo of Planago

On this website you can try Planago in a live demo, both the booking view for customers and the admin view. The demo runs on our own server at Hetzner Online GmbH in Germany. No data is passed on to third parties.

Data processing: If you make a test booking in the demo, the name and email address entered and the selected appointment are stored. As in real operation, test emails are sent to the email address provided, for example a booking confirmation; to prevent misuse, no more than three per hour and address. In addition, your IP address and technical access data are recorded for a short time to provide and secure the demo. For the forms and the login to the admin view, a technically necessary session cookie is set, which is deleted when you close the browser. So that the demo appears in the language of this website (German or English), a further cookie stores only the selected language (planago_demo_lang, 30 days, no personal data). Both cookies are technically necessary (§ 25(2) no. 2 TDDDG).

Please don't enter real data: The demo is public. Test bookings are visible to all visitors in the admin view of the demo until the next reset. Therefore, use a fictitious name and only an email address at which you want to receive the test emails.

Storage period: The demo is completely reset every night. All test bookings and the IP addresses stored for security purposes are deleted.

Legal basis: Art. 6(1)(f) GDPR. Our legitimate interest lies in demonstrating the features of Planago realistically to interested parties and protecting the demo from misuse.

8. AI support chat

On this website we offer a chat in which an AI assistant answers questions about Planago (“Questions?” button at the bottom right). The chat only transmits data after you click “Start chat” and send a message.

Data processing: Your messages and the previous course of the conversation are transmitted via our server to Anthropic, PBC, San Francisco, USA, which generates the answer with its AI model “Claude”. According to Anthropic, it does not use this data to train its models and only stores it for a limited period; details can be found in Anthropic's privacy policy at anthropic.com/legal/privacy. Please do not enter any personal data such as names, addresses or login details in the chat.

Storage by us: We do not store the content of the chats. The conversation history is only kept in your browser's memory (sessionStorage) and is deleted when you close the tab. To prevent misuse, we store your IP address together with the time of the request for no more than 24 hours.

Legal basis and transfer to a third country: The processing is based on your consent pursuant to Art. 6(1)(a) GDPR, which you give by clicking “Start chat”. The transfer to the USA is based on your explicit consent pursuant to Art. 49(1)(a) GDPR. The USA may not have a level of data protection comparable to the EU; in particular, US authorities may be able to access the data without effective legal remedies being available to you. The storage of the IP address is based on our legitimate interest in secure operation (Art. 6(1)(f) GDPR).

Withdrawal: You can withdraw your consent at any time with effect for the future by no longer using the chat and closing the tab. The chat is voluntary; all information can also be found in our FAQ, and you can reach us without AI via the contact form.

9. Withdrawal and cancellation via our website

Using the forms “Withdraw from contract” (withdrawal-form.html, German: widerruf.html) and “Cancel hosting” (cancel-hosting.html, German: hosting-kuendigen.html), you can withdraw from a licence purchase or cancel “Planago with hosting”. In doing so, we process the details you enter (for withdrawal: name, email address, invoice number or order date and optionally your address; for cancellation: address of the installation and email address used for the order) as well as the date, time and IP address of the submission.

The purpose is to process and document your declaration and to send the confirmation of receipt or cancellation by email. In the case of a cancellation, we transmit the end of the contract to our payment service provider Stripe (see section 4) so that no further payments are collected afterwards. The legal basis is Art. 6(1)(b) GDPR (performance or reversal of the contract) and Art. 6(1)(c) GDPR (statutory documentation and retention obligations). We store the details for as long as they are needed as evidence, at most until the statutory limitation and retention periods have expired. To prevent misuse, the IP address is also stored for no more than 24 hours to limit the number of requests.

10. Storage period and deletion

We process and store personal data only for as long as necessary to achieve the purpose of the processing, as long as statutory retention periods require it, or as long as there is a legal basis for the processing. Once the purpose no longer applies, a retention period expires or the legal basis ceases to exist, the data is routinely restricted or deleted in accordance with the statutory provisions.

11. Recipients in third countries

We only transfer personal data to third countries (outside the EU/EEA) if an adequacy decision of the European Commission exists (e.g. the EU-U.S. Data Privacy Framework for certified companies), if appropriate safeguards such as EU standard contractual clauses have been agreed (Art. 46 GDPR), or if you have given your explicit consent (Art. 49(1)(a) GDPR). You can obtain a copy of the relevant safeguards from us.
